W Stanach właśnie ruszył sądowy proces, jaki Epic, producent gry Fortnite, wytoczył Apple’owi. W analogicznej sprawie, przeciw Google’owi, Epic też już złożył pozew. Z kolei z inicjatywy Spotify Komisja Europejska w ubiegłym roku wszczęła dochodzenie przeciw Apple’owi i póki co uznała, że wniosek w tej sprawie jest zasadny. Stworzony przez Apple’a, wraz z premierą App Store’a, model finansowy zaczął się zatem chwiać w posadach.

Chodzi o 30 proc. prowizji, jakie Apple pobiera od sprzedawanych na jego elektronicznym targowisku aplikacji oraz od płatności dokonywanych potem w tych aplikacjach. Epic uruchomił własny sklep z dodatkami tańszymi niż przy zakupie z iPhone’a, łamiąc warunki umowy. W odpowiedzi Apple usunął Fortnite’a ze swojego sklepu, a wtedy Epic zarzucił Apple’owi stosowanie praktyk monopolistycznych. Z podobnym pozwem firma tawystąpiła przeciw Google’owi, który także pobiera 30-proc. opłatę od deweloperów wystawiających swoje aplikacje w Google Play.

Jak widać osiągnięciem Apple’abyło nie tylko doprowadzenie do powstania i rozwoju gospodarki platform, ale także ustalenie stawek, które branża uznała za standard. Takiej samej marży zaczęły żądać od producentów kolejne platformy sprzedaży online, oprócz Google’a także Microsoft, Samsung, Sony czy Nintendo. Wyraźnie wyłamuje się tylko Twitch Amazona, który dla siebie rezerwuje nie 30, ale… 50 proc.

Mówiąc bez ogródek, te 30 proc. to rozbój. Gdyby tyle chciało miasto od straganu na targowisku albo dajmy na to Visa za obsługę kart płatniczych, uznalibyśmy, że ktoś tam zwariował. Tymczasem wariata struga szef Apple’a, Tim Cook, opowiadając, że w czasach przedinternetowych, kiedy sklepy były z cegieł, a w zasadzie to z blachy falistej i z kartongipsu, pośrednicy brali 50 albo i 70 proc. ceny oprogramowania. Apple’owski „spodek” chyba właśnie wyprzedził roadstera Tesli prującego przez bezmiar kosmosu…

Ale hipokryzja dotyczy obu stron sporu. Epic, nie wiedzieć czemu, ostro traktuje Apple’a i Google’a, a nie ma pretensji do Microsoftu i Sony. Z kolei Skarżący się w Europie Spotify sam jest platformą dystrybucji cyfrowej, przy której stawkach dla muzyków Apple wydaje się być szczodrym dobrodziejem. Pokrzywdzony czuje się też niesłynący z handlowych skrupułów Facebook, odkąd zaczął oferować płatne transmisje na żywo, bo i od nich Apple pobiera 30 proc., jeśli zakup przechodzi przez App Store.

Dziś to (de facto konkurencyjne) platformy cyfrowe mówią o niesprawiedliwym podatku cyfrowym narzucanym przez inne platformy cyfrowe. Zauważyły go dopiero, gdy objął tandetne skórki do Fortnite’a, ale nie protestowały, gdy z App Store’a znikały wartościowe aplikacje informacyjne, bo ich wydawcy nigdy nie osiągali nawet takiej marży, jakiej żądał od nich Apple.

Platformy sprzedażowe Apple’a i Google’a są bez wątpienia ekonomicznym fenomenem ostatniej dekady. Szacuje się, że sam App Store generuje przychody rzędu 60 – 70 mld dol. rocznie. Dlatego rozstrzygnięcia w sprawach toczących się w Stanach i w Europie będą miały ogromny wpływ na całą gospodarkę cyfrową i na nasze portfele.

Choć wydaje mi się, że wiem, jaki wynik byłby korzystny, trudno mi z sympatią patrzeć na motywy krucjaty Epica czy Spotify przeciw Apple. Ale i wobec Apple’a trudno mi o sympatię w tej sprawie.
