]]> Avaya zamierza dokonać restrukturyzacji się dzięki procedurze "Chapter 11" (Rozdział 11 Kodeksu Upadłościowego). Procedura ta pozwala na utrzymanie funkcjonowania firmy i daje czas na reorganizację pod nadzorem sądu, zanim możliwe będzie wypełnianie zobowiązań przedsiębiorstwa wobec wierzycieli.

– Rozważaliśmy kilka alternatywnych wariantów pozwalających wyjść z trudnej sytuacji, ale doszliśmy do wniosku, że w obecnym czasie Rozdział 11 Kodeksu Upadłościowego jest najlepszym sposobem, aby pójść do przodu. Zmniejszenie zadłużenia spółki w oparciu o procedurę "Chapter 11" pozwoli firmie zbudować silną pozycję w przyszłości – mówi Kevin Kennedy, CEO Avaya. 

 Zadłużenie spółki wynosi około 6 mld dolarów. Dziennik „The Wall Street Journal” już  pod koniec listopada ubiegłego roku informował, że Avaya ogłosi wniosek o upadłość.  

Avaya działa na rynku telekomunikacyjnym od 2000 roku, wówczas z koncernu Lucent Technologies wydzielono dział Enterprise/BCS. Siedem lat później firmę przejęły za 8 mld dolarów  dwa fundusze inwestycyjne Silver Lake oraz TPG Capital. Avaya opracowuje systemy telekomunikacyjne dla biznesu, telefony systemowe, telefony IP, a także oprogramowanie do ujednoliconej komunikacji (UC) oraz do obsługi contact center.
