]]> Nie było zmowy największych operatorów komórkowych – uznał Sąd Najwyższy. Wyrok oddala skargę kasacyjną UOKiK w sprawie wyroku sądu apelacyjnego z 2017 r. Sprawa dotyczy decyzji z 2011 r. Otóż spółka Info-TV-FM, należąca do NFI Magna Polonia, dwa lata wcześniej wygrała przetarg organizowany przez UKE na rezerwację pasma do nadawania telewizji w telefonach. Startowało w nim także konsorcjum powołane przez największych operatorów – Mobile TV (Centertel – obecnie Orange, P4 – Play, Polkomtel – Plus i PTC – Era, obecnie T-Mobile). Po przegranej nie zdecydowali się jednak na umowy z Info-TV-FM, przez co nowa usługa nie mogła ruszyć, mimo że zwycięska spółka zapłaciła za pasmo ponad 15 mln zł. Operatorzy argumentowali, że cały biznes im się nie opłaca.

UOKiK zarzucił operatorom nielegalne porozumienie, które polegało na uzgadnianiu działań wobec konkurenta. Szkodę ponieśli zdaniem urzędu konsumenci, bo usługa, która była przedmiotem przetargu, nie ruszyła. Przeszukano ich siedziby. UOKiK nałożył na nich łącznie 113,3 mln zł kary (Centertel – 35 mln zł, PTC – T-Mobile – 34 mln zł, Polkomtel – 33,5 mln zł, P4 – Play 10,7 mln zł). Do tego doszły kary 130 mln zł i 123 mln zł na Polkomtel i PTC za utrudnianie postępowania.

Sąd stwierdził jednak, że porozumienie operatorów nie było nielegalne, skoro połączyli siły w jednym podmiocie. Uwzględnił również biznesowy kontekst rezygnacji telekomów z decyzji o uruchomieniu telewizji mobilnej.
