Zarzuca jej naruszenie zbiorowych interesów konsumentów.

]]> CT Creative Team oferuje na Wapsterze gry dla dzieci. Ich pobranie, uruchomienie i korzystanie z aplikacji było darmowe, ale każda zawierała opcje płatne smsem o podwyższonej stawce. Zdaniem UOKiK we właściwym czasie nie informowano o ich kosztach. Cennik i regulamin usługi były wprawdzie dostępne w aplikacji i na stronie internetowej, ale w opinii urzędu należało informować o kosztach również w trakcie gry i po każdej czynności związanej z naliczeniem dodatkowej opłaty.

UOKiK zakwestionował też sposób, w jaki użytkownicy byli zachęceni do zamawiania płatnych opcji. W większości wypadków pytanie poprzedzające zamówienie nie zawierało informacji o konieczności zapłaty, np. pytano: „Masz za mało bąbelków. Czy mimo to chcesz rozwinąć moc?”, a udzielenie odpowiedzi twierdzącej oznaczało zgodę na wysłanie smsa na numer o podwyższonej opłacie.

UOKiK nakazał zaprzestania niezgodnych z prawem praktyk i nałożył na CT Creative Team karę finansową – ponad 30 tys. zł. Decyzja nie jest prawomocna, spółka może odwołać się do sądu.

Jest to kolejne postępowanie urzędu wobec CT Creative Team w sprawie smsów o podwyższonej opłacie. W ubiegłym roku UOKiK zakwestionował treści reklamowe wysyłane do konsumentów w związku z konkursem smsowym Quiz wiedzowy. Nałożył wówczas na spółkę ponad 140 tys. zł kary. Podtrzymał ją Sąd Ochrony Konkurencji i Konsumentów.
