Przy zamawianiu i kontraktowaniu takich usług podstawowe znaczenie ma Prawo zamówień publicznych, które dopuszcza możliwość przetwarzania danych w chmurze i kupno takich usług w ramach standardowego zamówienia publicznego.

Ministerstwo Cyfryzacji przygotowało Standardy Cyberbezpieczeństwa Chmur Obliczeniowych (SCCO), które stanowią część Narodowych Standardów Cyberbezpieczeństwa. Pierwsza wersja SCCO została opublikowana w lutym 2020 roku. Ponadto na zlecenie Kancelarii Prezesa Rady Ministrów zostały opracowane Wytyczne dla administracji publicznej w zakresie wykorzystania usług chmurowych w sektorze usług publicznych.

Dostawcy i użytkownicy usług chmurowych powinni w swojej działalności uwzględniać także regulacje o charakterze pozaprawnym. Należą do nich wszelkiego rodzaju standardy, normy (w tym normy ISO), rekomendacje oraz zbiory dobrych praktyk. Dookreślają one wskazane na poziomie ustawowym wymagania i zasady korzystania z potrzebnych do prowadzenia działalności biznesowej systemów teleinformatycznych. Takie opracowania mogą mieć również charakter branżowy. Funkcjonują w sektorze bankowym, ubezpieczeniowym czy medycznym, jak też mają je radcy prawni.

I jest jeszcze jedna istotna kwestia. W związku z tak dużym rozproszeniem regulacji prawnych dotyczących chmury, szczególnego znaczenia nabiera umowa cywilnoprawna zawierana między usługodawcą i usługobiorcą. Jest podstawowym sposobem określania relacji pomiędzy poszczególnymi stronami świadczonej usługi chmurowej. Odpowiednio spisana, wskazująca wzajemne zobowiązania i uprawnienia, staje się kluczem do dobrej współpracy biznesowej dostawcy środowiska chmurowego bądź jego partnera z klientami. Ze względu na znaczącą rolę umów w kontraktach chmurowych wśród przepisów o charakterze ogólnym istotne znaczenie będzie miał jeszcze Kodeks cywilny. Warto pamiętać również o nim.

Dlatego Google kładzie duży nacisk na budowanie kanału partnerskiego i naszego zaangażowania w cały proces. W obszarze Google Cloud Platform największe wykorzystanie chmury widzimy w branżach takich jak: ochrona zdrowia, digital native oraz gaming.
