Większe prawa dla przedsiębiorców?
Do Komitetu Rady Ministrów trafił projekt ustawy prawo działalności gospodarczej. Nowe przepisy mają wzmocnić gwarancje dla przedsiębiorców.
Resort chce wprowadzić 15 zasad prowadzenia biznesu. Uporządkowane mają zostać relacje między przedsiębiorcami a organami administracji. Szczególnie ważny może się okazać zapis o domniemaniu uczciwości – oznacza, że nawet jeśli pozostaną wątpliwości dotyczące oceny stanu faktycznego w danej sprawie, administracja będzie zobowiązana do rozstrzygania niewyjaśnionych kwestii na korzyść przedsiębiorcy. (Wpisuje się to w dyskusję, która wynikła w trakcie prac nad nowelizacją Ordynacji podatkowej. Uchwalone w ubiegłym tygodniu przez Sejm nowe przepisy wprowadzają zasadę rozstrzygania wątpliwości podatkowych na korzyść podatnika.)
Nowe przepisy mają być kompletną regulacją.
– Jeśli ścieżka legislacyjna zakończy się pozytywnie, czyli projekt zaakceptują Rada Ministrów, Sejm, Senat i prezydent, to może ona obowiązywać od 1 stycznia 2016 roku – mówi Mariusz Haładyj, wiceminister gospodarki.
