Śmiały wyrok w sprawie Google
Sąd Apelacyjny w Warszawie nakazał usunięcie z wyszukiwarki wyniku, który narusza dobre imię prywatnej osoby.
Sprawę przeciwko firmie Google wytoczył biznesmen z Olsztyna. Warszawski sąd nakazał internetowemu gigantowi usunąć zaskarżone wyniki wyszukiwania oraz zapłacić poszkodowanemu zadośćuczynienie – podała Rzeczpospolita. Google ma usunąć link kierujący do treści dotyczących powoda.
W październiku 2015 r. sąd okręgowy oddalił powództwo. Uznał, że Google Polska nie może odpowiadać za wyniki wyszukiwarki, ponieważ nie ma kontroli nad serwerami znajdującymi się w USA. Z kolei centrala firmy, czyli Google Inc., naruszyła w opinii sądu dobra osobiste w sposób znikomy.
Sąd apelacyjny uznał natomiast, że amerykański gigant podlega jego jurysdykcji. Postępowanie w drugiej instancji toczyło się więc przeciw Google Inc. Ma on usunąć z wyszukiwarki wskazany link i zapłacić powodowi 10 tys. zł zadośćuczynienia.
