Rada Ministrów przyjęła pakiet unijnych rozwiązań, które mają załatać dziurawy obecnie system poboru VAT od zakupów internetowych spoza UE, głównie z Chin – tym samym wyrównując szanse obłożonych daninami polskich firm w rywalizacji z chińskimi platformami e-handlu.

„To szczególnie ważne dla rodzimych pośredników, portali aukcyjnych i sprzedażowych, które zmagają się często z nieuczciwą konkurencją spoza UE” – przyznaje minister finansów Tadeusz Kościński.

Sprzedają taniej o VAT

Wprowadzenie nowych regulacji zapowiedziano w ub.r. Celem nowych przepisów jest ograniczenie napływu paczek z nieopodatkowanymi towarami z krajów trzecich do Unii Europejskiej.

„Tracą na nim nie tylko budżety poszczególnych państw, ale przede wszystkim unijni przedsiębiorcy. Nie mogą konkurować z firmami, często z operującymi z dalekiego wschodu, które sprzedają takie same towary, co oni, ale tańsze o VAT, czyli często nawet o jedną czwartą. Pakiet e-commerce jest istotnym krokiem w kierunku ukrócenia tego procederu” – komentuje wiceminister finansów Jan Sarnowski.

Olbrzymia skala problemu

Jak wynika z ubiegłorocznego raportu Związku Przedsiębiorców i Pracodawców, jest sporo do zrobienia w sprawie uszczelnienia VAT w e-handlu z Chinami, bo skala problemu jest gigantyczna.

Według przytoczonych w raporcie danych ze specjalnego oddziału KAS z sortowni w Lublinie, który monitoruje dostawy z Chin, w okresie od grudnia 2018 r. do listopada 2019 r. z 10,7 mln przesyłek, jakie przeszły przez sortownię, ponad 90 proc. zostało nadanych w Chinach, a podatki lub cła nałożono na ok. 8,5 tys. szt. (mniej niż promil). Opłaty pobrane z tego tytułu wyniosły zaledwie 890 tys. zł (śmieszna kwota jak na cały rok). Zaś w całym kraju pobrano od takich przesyłek 1,2 mln zł VAT.

Z unijnych szacunków wynika natomiast, że straty budżetów krajów UE z powodu de facto nie działającego systemu kontroli granic przed nieopodatkowanym e-handlem spoza UE wynoszą ok. 5 mld euro rocznie.

  • likwidacja w całej UE zwolnienia z VAT od importu tzw. małych przesyłek o wartości do 22 euro
  • znaczne rozszerzenie zakresu transakcji B2C, które dla celów VAT mogą zostać rozliczone za pomocą uproszczonej procedury One Stop Shop
  • nałożenie obowiązku poboru i zapłaty VAT na podatników.
    Według resortu finansów ułatwi to, poprzez użycie interfejsu elektronicznego (czyli np. na portalu e-commerce), dokonanie na terytorium UE:
    · sprzedaży towarów importowanych z państw trzecich, w przesyłkach o rzeczywistej wartości do 150 euro, a także
    · dostawy towarów na rzecz konsumentów.
  

AliExpress nie składa broni

Nowe rozwiązania nie są jednak zaskoczeniem także dla AliExpress, który już się do nich przygotowuje. Według zapewnień z początku roku, wejście w życie pakietu e-commerce nie będzie oznaczać podwyżki wszystkich cen w serwisie. Chiński koncern zamierza więc trzymać ceny w ryzach, a do tego powalczyć o polskich klientów skróceniem czasu dostaw.

Siłą tego biznesu pozostaje także z pewnością duży zasięg i rozpoznawalna marka. AliExpress to najlepiej znana polskim konsumentom zagraniczna platforma e-handlu i trzecia w kraju pod względem rozpoznawalności (po Allegro i OLX) – spontanicznie rozpoznaje tę markę 19 proc. konsumentów – według danych Gemiusa z ub.r.

Inna sprawa, czy system poboru VAT od e-zakupów z Chin rzeczywiście uda się uszczelnić w takiej skali, którą odczują polscy przedsiębiorcy. Jak będzie, okaże się w praniu.

Rozliczenie VAT w jednym okienku

Obok poprawy konkurencyjności polskich przedsiębiorców, korzyścią wynikającą z nowego pakietu e-commerce jest według ministerstwa zmniejszenie kosztów realizacji obowiązków VAT, związanych z transakcjami transgranicznymi B2C.

Pakiet e-commerce ułatwi działanie firmom wysyłającym towary z Polski do konsumentów w innych krajach Europy.

„Przedsiębiorcy handlujący w internecie nie będą już musieli oddzielnie rejestrować się na potrzeby VAT i rozliczać w każdym kraju, do którego wysyłają towary. Zamiast tego rozliczą VAT w „jednym okienku”, w państwie swojej siedziby. I to już państwo, w którym działają, podzieli się zapłaconym przez nich podatkiem z krajem, do którego trafiła przesyłka. Oszczędzi to firmom wiele kosztów i formalności” – wyjaśnia wiceminister finansów.
