Pułapka w płatności faktur gotówką
Fiskus zaostrzył stanowisko wobec przedsiębiorców regulujących faktury gotówką. Całej zapłaty na ponad 15 tys. zł nie można wliczyć w koszty.
Regulowanie należności z pominięciem rachunku bankowego może okazać się dla przedsiębiorcy bardziej kosztowne niż dotychczas. Otóż zapłaty gotówką faktury na kwotę ponad 15 tys. zł w całości nie można zaliczyć do kosztów podatkowych – zgodnie z najnowszą interpreracją dyrektora Krajowej Informacji Skarbowej, o której informuje prawo.pl. Dotychczas była mowa o tym, że jedynie nadwyżka ponad 15 tys. zł nie idzie w koszty. Takie przepisy obowiązują od 2017 r., gdy znacznie obniżono ten limit (wcześniej wynosił 15 tys. euro). Miało to według resortu finansów zapobiec fikcyjnym transakcjom.
Interpretacji KIS towarzyszy niejasna definicja transakcji, z którą wiąże się niekorzystne dla przedsiębiorców stanowisko. Dla firm oznacza to ryzyko błędu i konsekwencji podatkowych.
