Polkomtel uniknął ok. 150 mln zł kary
Zapadł wyrok sądu.
Zapadł kolejny korzystny dla telekomu wyrok sądu w sporze z UOKiK.
Operator sieci Plus nie będzie musiał zapłacić 33 mln euro kary (ponad 150 mln zł), jaką wymierzył mu UOKiK. Wyrok sądu najwyższego obniży stawkę do 300 tys. euro (ok. 1,4 mln zł) – informuje „Puls Biznesu”.
Takie cięcie wynika z tego, iż w ocenie SN urząd zastosował nieprawidłowy przelicznik wysokości kary w euro. Zmiana kursu spowoduje 100-krotną obniżkę stawki.
Wyrok dotyczył sprawy, która ciągnie się od 2009 r. W ocenie UOKiK Polkomtel i kilka innych spółek uczestniczyło w zmowie mającej na celu ograniczenie konkurencji na rynku telewizji mobilnej. Operator Plusa dodatkowo miał utrudniać kontrolę, stąd tak wysoka wspomniana kara.
Jest to kolejny sądowy sukces operatora Plusa w sporach z UOKiK. W sierpniu br. decyzją warszawskiego sądu apelacyjnego obniżono z ponad 50 mln zł do niecałych 17 mln zł karę nałożoną przez urząd w 2020 r.
