NSA uznaje wysyłanie faktur e-mailem
Naczelny Sąd Administracyjny stwierdził, że faktury przesłane mailem powinny być traktowane na równi z dostarczonymi zwykłą pocztą.
20 maja 2010 r. Naczelny Sąd Administracyjny ogłosił wyrok, z którego wynika, że faktury przesyłane drogą elektroniczną są tak samo ważne jak te nadane tradycyjną pocztą. W sprawie chodziło o rozstrzygnięcie, czy podatnik może rozliczyć VAT na podstawie faktur wysłanych e-mailem lub faksem, choć nie miały one formy e-faktur, tzn. nie zostały opatrzone podpisem elektronicznym. Zarówno Izba Skarbowa, jak i Wojewódzki Sąd Administracyjny stwierdziły, że podatnik nie może tego zrobić. Jednak NSA wydał w tej sprawie odmienny wyrok. Zdaniem specjalistów postawienie poczty elektronicznej na równi z tradycyjną może ułatwić życie przedsiębiorcom. Sygnatura sprawy: I FSK 1444/09 (na razie brakuje jeszcze pisemnego uzasadnienia) .
