NSA chce podnieść opłaty za sprawy podatkowe
Dochodzenie swoich racji w sporze z fiskusem będzie kosztować w sumie 5 razy więcej niż teraz. Prawdopodobnie wzrosną opłaty od skarg na interpretacje organów skarbowych, wnoszonych do sądów administracyjnych.
Podwyżki proponuje prezes NSA. Obecnie opłata od skargi wnoszonej do Wojewódzkiego Sądu Administracyjnego na interpretacje fiskusa wynosi 200 zł. Jeśli sprawa trafi do Naczelnego Sądu Administracyjnego, trzeba dopłacić kolejne 100 zł. Prezes chce, by stawki zwiększono do 750 zł w przypadku WSA i 750 zł dla NSA (czyli w sumie 1500 zł zamiast 300 zł). Ich wysokość jest (i będzie) dla wszystkich skarżących identyczna, niezależnie od wartości przedmiotu sporu. Podwyżka ma na celu ograniczenie spraw podatkowych rozpatrywanych przez sądy administracyjne (zapewne ustawodawca uważa, że jak jest taniej, to ludzie skarżą skarbówkę z błahego powodu), co powinno przyspieszyć rozpatrywanie sporów (obecnie trzeba czekać nawet 2 lata). Poza tym aktualne opłaty uznano za zbyt niskie w kontekście skomplikowanych problemów podatkowych, jakimi muszą zajmować się sądy.

NSA: zwrot VAT-u dopiero po wykluczeniu oszustwa
Jeżeli spółka wnioskuje o zwrot VAT-u, a u jej kontrahentów trwa kontrola, przedsiębiorca musi poczekać na jej zakończenie - wynika z orzeczenia NSA.
