Nowy wyrok dotyczący Lexmarka
Ta decyzja sądu może nie spodobać się koncernom drukarkowym.
Sprawa dotyczy sprzedaży ponownie napełnianych wkładów atramentowych Lexmarka. Producent pozwał przedsiębiorców, którzy uzupełniają tuszem i sprzedają używane materiały eksploatacyjne. Amerykański sąd w 2016 r. uznał, że naruszają oni prawa patentowe Lexmarka i zakazał sprzedaży ponownie napełnianych wkładów.
Jednak teraz karta odwróciła się. Sąd Najwyższy USA opowiedział się przeciwko zakazowi stosunkiem głosów 8:0.
"Kontynuacja praw patentowych po pierwszym zakupie będzie blokować kanał sprzedaży, bez zauważalnych korzyści z dodatkowej kontroli, jaką miałby wtedy właściciel patentu" – napisał w uzasadnieniu sędzia odpowiedzialny za sprawę.
Wyrok to nie tylko porażka Lexmarka. To także zła wiadomość dla innych producentów drukarek, którzy mają podobny problem z dostawcami ponownie napełnianych materiałów eksploatacyjnych. Spory dotyczące tych produktów ciągną się od lat. Lexmark toczy je już od ponad dziesięciolecia.
