Związek Cyfrowa Polska, zrzeszający największe firmy z branży RTV i IT działające w Polsce, przekazał do MSWiA uwagi branży w związku z pracami nad nowelizacją ustawy o cudzoziemcach.

Związek apeluje m.in o uzupełnienie listy podmiotów o szczególnym znaczeniu strategicznym dla Polski, w których zatrudnienie cudzoziemców odbywać się będzie na specjalnych zasadach oraz o nakładanie kar na urzędników, którzy nie będą dotrzymywali terminów rozpatrywania wniosków o pozwolenie na pracę.

„Wiele firm z naszego rynku boryka się dziś z problemem niedoboru pracowników. Regulacje, które przyśpieszą proces zatrudniania obcokrajowców w kraju są dla nas kluczowe” – mówi prezes Związku Cyfrowa Polska, Michał Kanownik.

Projekt przewiduje ułatwienie uzyskania zezwolenia na pracę przez cudzoziemców w podmiotach o szczególnym znaczeniu strategicznym dla gospodarki kraju.

Związek firm IT apeluje o udostępnienie listy tych podmiotów i proponuje, by znalazły się na niej te firmy, instytucje i organizacje, które podpisały porozumienie cenowe z polskim fiskusem. Według organizacji zapewnia ono sprawne rozliczenia i większe wpływy z CIT.

Cyfrowa Polska jednocześnie przestrzega przed zawartymi w projekcie zmianami w składaniu wniosków o pobyt czasowy i pracę. Otóż do uzyskania zezwolenia na pobyt czasowy i pracę, nie będzie konieczna umowa o pracę ani umowa najmu mieszkania. Zdaniem szefa związku takie rozwiązanie doprowadzi do zatorów w urzędach wojewódzkich.

„Może skutkować ogromnym zwiększeniem liczby wniosków. Obawiamy się, że taka propozycja nie tylko nie poprawi sytuacji migracyjnej i pracy urzędów, lecz wręcz ją pogorszą” – uważa Michał Kanownik.

Organizacja proponuje też rezygnację z konieczności zmiany decyzji pobytowej, w przypadku nowych warunków zatrudnienia, np. zmiany stanowiska.

Przyjęcie projektu przez Radę Ministrów przewidziane jest na III kw. 2021 r.

Polski Ład może zniechęcić fachowców IT do pracy w polskich firmach

Niestety istnieje ryzyko, że mimo nowej ustawy o cudzoziemcach inne regulacje odstraszą fachowców IT z zagranicy. Chodzi o Polski Ład. Zwracały na to uwagę organizacje sektora informatycznego – IT Corner, Stowarzyszenie Klaster ICT Pomorze Zachodnie oraz SoDA w opinii na temat projektu Polskiego Ładu. Zdaniem ekspertów wejście w życie przepisów, obciążających jeszcze bardziej koszty pracy specjalistów, sprawi że zagraniczni fachowcy IT nie będą palić się do tego, by pracować dla polskich firm.

„Polska stanie się nieatrakcyjnym podatkowo kierunkiem, co spowoduje kolejne problemy branży” – stwierdzono w opinii.

Z kolei rodzimi fachowcy łaskawszym okiem mogą spoglądać na oferty spoza kraju. „Mniejsze firmy mogą nie udźwignąć nowego podziału kosztów i zniknąć z rynku” – przestrzegają organizacje branży IT.
