MCI wygrało ze Skarbem Państwa – 29 mln zł odszkodowania za stratę na akcjach JTT Computer

Sąd apelacyjny we Wrocławiu przyznał MCI 29 mln zł rekompensaty od Skarbu Państwa plus odsetki za stratę, jaką firma poniosła wskutek bezprawnej decyzji skarbówki i doprowadzenie do upadłości JTT Computer.

MCI domagało się 38,5 mln zł wraz z odsetkami za to, że
wskutek decyzji organów skarbowych, które wbrew prawu wyegzekwowały od JTT
Computer ponad 10 mln zł, spółka popadła w problemy finansowe i w efekcie została zlikwidowana. Sąd potwierdził, że działania skarbówki przyczyniły się spadku wartości i w dalszej konsekwencji do zakończenia działalności JTT
Computer, natomiast sumę utraconych korzyści biegli ocenili niżej niż w
pozwie złożonym przez MCI – ich zdaniem gdyby nie feralna decyzja skarbówki, pakiet akcji JTT Computer, który był w posiadaniu MCI w czerwcu 2004 r. (a więc
wtedy, gdy MCI pozbył się papierów) byłby wart 29 mln zł. Taka też jest
zasądzona kwota odszkodowania (do tego dojdą odsetki w wysokości 17 mln zł). W 2004 r. MCI sprzedało akcje JTT
za 45 tys. zł.
